Terms of Agreement

Effective date: Dec 7, 2023

1. Introduction

This agreement is between the "Client" (the individual or entity requesting the charter service) and "KinectAir" (the company providing the charter service). By signing this agreement, the Client confirms the reservation of the aircraft for the specified date(s) and time(s) and accepts the terms and conditions set forth below.

2. Reservation and Payment

  • The quoted price is valid for 48 hours from the date it's provided.
  • Full payment is required to secure the reservation.
  • A 4% discount is applied if payment is made via ACH transfer or check.
  • A 4% processing fee is added for credit card payments.
  • A credit card is required to confirm the reservation and will be kept on file for any additional charges.

3. Additional Charges

Additional charges may be incurred for reasons including but not limited to:

  • Extra flight time due to weather or air traffic control reroutes
  • De-icing or hangar fees to prevent de-icing.
  • Damage caused by passengers beyond normal wear and tear.
  • Interior cleaning if pets are on board.
  • Additional services requested by passengers.

4. Cancellations and Refunds

KinectAir is not liable for expenses for alternative transportation in case of partial flight completion due to mechanical issues.

  • Full refunds are issued within 14 days after cancellation, provided the cancellation is made by KinectAir.
  • For round-trip US domestic flights, cancellations made within 4 days of departure will incur a charge of 50% of the quoted price plus actual expenses; within 3 days or no-shows, 100% of the quoted price plus actual expenses.
  • Similar terms apply for round-trip international flights, one-way, and empty leg flights with specified notice periods.

5. Holiday Periods

Special cancellation charges apply during holiday periods (November 20-December 4; December 18-January 8; February 9-February 13).

6. Itinerary Revisions

Changes are allowed, subject to availability and price adjustments. Notify KinectAir via email at fly@kinectair.com with any changes or cancellations.

7. Pet Policy

Pets must be approved during booking. Unannounced pets may incur cleaning fees or, if declined, a cancellation charge of 100% of the quoted price plus actual expenses.

8. Check-In and Baggage

  • Check-in is 15 minutes before departure.
  • Baggage limits apply and vary per charter. Prior approval is required for extra baggage.

9. Legal Jurisdiction

This agreement is governed by Oregon state law. Claims must be presented in writing within 10 days of the return flight.Provide space for the Client’s information, initials, and signature at the end of the document as previously formatted. Your billing information section can remain unchanged. This revised version aims to present the terms in a more organized and clear manner, making it easier for the Client to understand the agreement they are entering into.
